Kazakhstan said ‘yes’ to ‘New Kazakhstan’

Kazakhstan Central Election Committee announced the preliminary results of the constitutional referendum held yesterday across the country.

Report, approximately 8 million (68 percent) of 11 million 734 thousand 642 registered voters in the country with a population of 19 million went to the polls yesterday to answer the question “Do you accept the amendments and annexes to the Constitution of the Republic of Kazakhstan”.

While 77.18 percent of the voters who went to the ballot box voted “yes”, 18.66 percent answered “no”.

Thus, after 27 years, Kazakhstan held a constitutional referendum for the second time in the country’s history to start the new era called “New Kazakhstan”.

It was stated that in case of a “yes” vote in the referendum, it was aimed to change the 33 basic issues of the current constitution, which was last accepted in 1995, and thus to reconstruct the administrative system in the country after the mass events that broke out at the beginning of January this year.


In the draft of the new constitution, the clause “Kazakhstan land and underground natural resources belong to the state” will be changed to “Kazakhstan land and underground natural resources belong to the people”.

The death penalty will be abolished altogether. Thus, the death penalty, which is allowed to be used as an exceptional punishment for those who committed terrorist mistakes and mistakes during the war period in the current constitution, will not be applied under any rule.

As long as the President of Kazakhstan continues his mission, he will not be a member of a political party. The issue in question will apply to the leaders and members of the Constitutional Board, the Supreme Court, the Central Election Board, the Court of Accounts, as well as judges, law enforcement personnel, national security forces and military workers.

The president’s close relatives will be banned from being appointed to high-level positions in the state and to the management of state-owned companies.

The Constitutional Council of Kazakhstan will be established as the Constitutional Court. The Constitutional Court, which is planned to be operational as of January 1, 2023, will consist of 11 judges and the members will be elected for a 6-year term of office.


In the draft constitution, the current supreme presidential administration system in the country will come to an end. Parliament will be stronger.

Thus, the power of the state leader to annul the decisions of metropolitan municipality leaders and state governors will be removed from the constitution.

The number of deputies the president appoints to the upper house senate will be reduced from 15 to 10. 5 of them will be proposed by the People’s Assembly of Kazakhstan. Thus, with the removal of the assembly’s function of appointing deputies to the parliament, the number of deputies in the lower house of the parliament will decrease from 107 to 98.

Only the lower house of parliament will have the power to pass laws. Relative representation system will be applied in order to represent the whole social layer in the assembly, where the powers of the speech will be expanded with the reform.

In addition, in the country where the metropolitan municipality leaders and provincial governors were previously appointed by the president, the candidates in question must first be approved by the local assembly deputies.

The parliament’s function of questioning the state budget will expand.

The issue regarding the Kazakhstan human rights ombudsman will be added. In this way, the ombudsman’s duty will be independent and he cannot be arrested without the approval of the senate during his mission.

On the other hand, within the scope of the amendments to be made, the law on the First President, which includes the constitutional status of the founding President Nursultan Nazarbayev, who resigned from his mission in March 2019 after ruling Kazakhstan for 28 years, will also be repealed.
